1. Preamble

2. Purpose
This contract is a distance contract that aims to define the rights and obligations of the parties in connection with the sale of seamar.ma products on the Internet, through the CMI platform.

3. Definitions

“Distance Contract”: any contract concerning goods or services between seamar.ma and a Consumer within the framework of a system of sale or provision of services at a distance organized by seamar.ma which, for this contract, uses exclusively the Internet network until the conclusion of the contract, including the conclusion of the contract itself.
“Consumer”: any natural person who, in this contract, acts for purposes that do not fall within the scope of his professional activity.
“Order form”: a document which indicates the characteristics of the Products ordered by the Consumer and which must be signed by him by “double click” to commit him.
“Order”: act by which the Consumer undertakes to buy Products and seamar.ma deliver.
4. Product
All products in the catalog are marketed while stocks last.
seamar.ma reserves the right to withdraw an item from the catalog, and without notice, it can in no way be required to compensate or cancel an order following the impossibility of using the purchased product for a reason of incompatibility with equipment already owned by the buyer.
5. Placing an order
After finding the product(s) you are interested in, click on the “order” button, the product is then added to your order form.

6. Price
The selling price of the product is in force at the time of registration of the order, excluding delivery costs which are the responsibility of the CUSTOMER and indicated when the order is registered.
The selling price of a product can be modified at any time. This modification will be notified to the CUSTOMER before any order validation or order delivery.
The prices mentioned in the catalog are indicated in Moroccan dirham all taxes included, are valid at the time of their consultation by the customer, and are those in force at the time of the order.
VAT is calculated in the order form according to the rate applicable on the day of the order. The order form and transactions are made in Moroccan DH.
Any change in the rate will automatically be reflected in the price of the products.
7. Shipping
The order will be shipped at the latest within 72 hours from the day following that on which the Consumer placed his order.
In the event of unavailability of the Product ordered, the Consumer will be informed as soon as possible and will have the possibility of canceling his order.
He will then have the choice to request either the reimbursement of the sums paid within thirty days at the latest of their payment, or the exchange of the Product.
8. Delivery
The delivery is not ensured by seamar.ma, the customer will recover his goods at the delivery address indicated on his Order form.
The Products are delivered to the address indicated by the Consumer on the Order Form. The Consumer is required to check the packaging of the goods on delivery and report the damage due to the carrier on the delivery note as well as to the shipping company within one day.
The Consumer may, at his request, obtain the sending of an invoice to the delivery address by validating the option provided for this purpose on the Order Form.

What are the delivery times?

9. Method of payment

Your credit card payment is secured by the CMI which offers a fully secure payment service.
The Consumer guarantees seamar.ma that he has the necessary authorizations to use the method of payment chosen by him, during the validation of the Order form.
In the event of payment by credit card, the provisions relating to the fraudulent use of the means of payment provided for in the agreements concluded between the Consumer and the issuer of the card between seamar.ma and his banking establishment apply.
10. Data Privacy
The information requested from you is necessary to process your order and is treated confidentially.
You have the right to rectify data concerning you.
You may receive advertisements from seamar.ma unless you have stipulated that you refuse the use of your personal data for its purposes.
11. Cancel an order
You can cancel your order at any time before the receipt of delivery confirmation from seamar.
To cancel, simply use the cancellation link on your e-receipt.
12. Right to retract
From the date of delivery of your order, you have a period of 14 day to assert your right of withdrawal and be fully reimbursed. The costs of returning the goods remain at your expense. However, only goods returned in perfect condition for resale, complete, and in their original packaging (unopened) can be refunded.
13. Guarantee
This guarantee does not cover damage resulting from accidents, misuse, or negligence.

The data was recorded by CMI S.A on the CMI platform on behalf of Seamar.ma constitutes proof of all commercial transactions between you and Seamar.ma
15. Force majeure
In fact, the liability of seamar may be incurred in the event of loss or damage caused to the parcel during carriage or non-delivery, unless the sender or consignee fails to do so, force majeure case, defect specific to the object, and insufficient packaging which is exemption cases. The liability of seamar is incurred for the value of the goods at the date of receipt or the amount of its repair.
